Personal Information Protection and Electronic Document Act
Our Privacy Policy:
Enterprise Charlotte (EC) is committed to protecting the privacy of the personal information of its clients. As of January 1, 2005 the federal Personal Information Protection and Electronic Documents Act (PIPEDA) applies to the operations of EC. Our pledge is to safeguard the privacy rights defined in PIPEDA and all other relevant laws.
Client information collected by EC for its database pertains to contact information only:
Name, Title, Company or Organization, Address, Phone, Fax, Email and Website.
Client information collected by EC will not be sold or distributed to any third parties.
Client information collected by EC for the agency database is only accessible by agency staff.
It is the responsibility of each member of the staff to adhere to the Privacy Policy.
Our Privacy Principles:
1. Accountability: We have designated an individual as the person who is accountable for ensuring we use personal information appropriately.
2. Identifying Purposes: We will identify the purposes for collecting personal information at or before the time the information is collected.
3. Consent: We will only collect, use or disclose your personal information with your knowledge and consent as accorded by law.
4. Limiting Collection: We will only collect personal information that is necessary for the purposes we have identified.
5. Limiting Use, Disclosure and Retention: We will not use or disclose personal information for purposes other than those for which it was collected, except with consent or as required by law. Personal information will be retained only as long as necessary for fulfillment of those purposes.
6. Accuracy of Information: Personal information will be as accurate, complete and up-to-date as is necessary for the purposes for which it is to be used.
7. Safeguards: Personal information will be protected by security safeguards appropriate to the sensitivity of the information.
8. Openness: We will make readily available to individuals specific information about our policies and practices relating to the management of personal information.
9. Individual Access: Upon request, an individual will be informed of the existence, use and disclosure of his or her personal information and will be given access to that information. An individual can challenge the accuracy and completeness of the information and have it amended as appropriate.
10. Challenging Compliance: An individual can address a challenge concerning compliance with the above principles to our Board, who is accountable for compliance with these principles.
Our Definitions:
Collection: the act of gathering, acquiring or obtaining personal information from any source, including from third parties, by any means. Personal information that is necessary to carry on the business Enterprise Charlotte.
Consent: voluntary agreement with what is being done or proposed. Consent can be either express or implied. Expressed consent is given explicitly, either orally or in writing. Expressed consent is unequivocal and does not require any inference on the part of Enterprise Charlotte seeking consent. Implied consent arises where consent may reasonably be inferred from the action or inaction of the customer.
Client: individuals and businesses about whom Enterprise Charlotte collects personal information in order to carry out the business of Enterprise Charlotte; and includes individuals who work in the agency, serve on the board of directors or serve on a committee of the board.
Disclosure: making personal information available to others outside Enterprise Charlotte.
Enterprise Charlotte: the non-profit community economic development agency for Charlotte County.
Personal Information: information about a client that is recorded in any form. It may include an individual’s name, address, telephone number, date of birth, occupation, medical and health records, assets, liabilities, income, credit rating.
Use: treatment and handling of personal information within Enterprise Charlotte.
Why Enterprise Charlotte Needs Personal Information?
Enterprise Charlotte provides services to a wide range of clients. In doing so, we may from time to time distribute materials concerning services and new developments relevant to your business.
Security Measures:
Information collected by EC is available to the agency staff and Executive Director only.
In the case of hard copy, the information is kept in locked cabinets.
In the case of electronic format, information is pass code protected and is available to the staff and Executive Director only.
Communicating with Us
You should be aware that email is not a 100% secure medium, and you must be aware of this when contacting us to send personal or confidential information.
Access to Personal Information:
You have a right to submit a written request to access your personal information that is in our possession and make corrections to it. Such a request is to be made to our Privacy Officer at the address listed below. We will respond to your request within 30 days or advise you if additional time is required to respond to your request. We will amend personal information that is demonstrated to be inaccurate or incomplete.

Complaint Procedures:
If a client has a complaint pertaining to the use of information he/she is requested to contact (in writing) the Internal Privacy Officer. The Privacy Officer will respond to the complaint within five (5) working days of receipt of the complaint.
All complaints under this policy will be treated seriously, dealt with promptly in a confidential manner and may not be used to affect the provision of any goods or services either requested or contracted to be supplied to the complainant.
Complaints under this policy are those that relate to collection of personal information or how it is collected, stored, used or disclosed.
